Welcome to Zenna (“we,” “our,” or “us”), a migraine sound session application. By accessing or using our application, you agree to be bound by these Terms & Conditions. Please read these terms carefully before using our services.

These Terms & Conditions contain important information about your legal rights and obligations. By using Zenna, you confirm that you have read, understood, and agree to these Terms & Conditions in their entirety.

2. SERVICES DESCRIPTION

Zenna provides personalized sound sessions designed to support wellness for individuals who experience migraines and headaches. Our service and customer support are provided in English only. Users are responsible for understanding English-language content. You must be 16 years or older to use the app.

Our application:

  • Collects information about your migraine and headache symptoms and triggers
  • Generates customized wellness audio session based on your personal data
  • Tracks patterns and effectiveness of treatments over time
  • With your explicit consent, contributes to broader migraine and headache research to improve treatment outcomes

3. ACCOUNT REGISTRATION

To use our services, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Be 16 or over to use the app
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Accept responsibility for all activities that occur under your account

We reserve the right to disable any account if we believe the information provided is false, inaccurate, or in violation of our Terms.

4. DATA COLLECTION AND SPECIAL CATEGORY DATA

a) Data Collection For Essential Service

To provide you with a personalized sound session, we need to collect and process certain information about your migraine and headache symptoms. This includes health-related data that qualifies as “special category data” under applicable data protection laws, such as:

  • Pain characteristics (severity, location, type)
  • Associated symptoms (such as nausea or light sensitivity)

  • Current treatment approaches

This processing is necessary for providing our sound session service and cannot be disabled while using the app, as it is essential to the core functionality of personalizing your session. You will be asked to provide this explicit consent before any health data is collected or processed through the app. We process this health data only with your explicit consent, in accordance with Article 9(2)(a) of the UK GDPR and the EU GDPR, as well as relevant provisions of the UK Data Protection Act 2018 and other applicable laws.

You may withdraw your consent at any time by deleting your account or contacting us, but this may affect your ability to use the app.

When using Zenna, you agree to:

  • Not use the app as a replacement for professional medical advice or emergency care
  • Consult with healthcare professionals regarding severe or unusual symptoms
  • Not share your account credentials with others
  • Use the app in compliance with applicable laws and regulations
  • Not attempt to reverse engineer, modify, or create derivative works based on the app
  • Use the app and engage with the sessions with reasonable care (e.g., turn down the volume if it is too loud, discontinue use if you feel pain)

6. LIMITATION OF LIABILITY

a) Not Medical Advice

Zenna provides sound sessions as a complementary approach to wellness. It is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of qualified healthcare providers with any questions regarding your medical condition.

b) No Guarantee of Results

While many users experience benefits from sound sessions, we do not guarantee specific results. The effectiveness of our service may vary among individuals.

c) Limitation of Liability

To the maximum extent permitted by law, Zenna and its affiliates, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses resulting from:

  • Your use or inability to use our services
  • Any unauthorized access to or use of our servers and/or personal information
  • Any interruption or cessation of transmission to or from our services
  • Any bugs, viruses, or other harmful code that may be transmitted through our service
  • Any violation of your user responsibilities

Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable law, including liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.

7. INTELLECTUAL PROPERTY

All content, features, and functionality of the Zenna app, including but not limited to text, graphics, logos, sound recordings, and software, are owned by Zenna or its licensors and are protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our app except as permitted by these Terms & Conditions.

8. TERMINATION

We may terminate or suspend your account and access to our services immediately, without prior notice or liability, including but not limited to:

  • Breach of these Terms & Conditions
  • Misuse of the app, including the provision of knowingly false or misleading health information
  • Fraudulent activity or abuse of our services

Upon termination, your right to use the service will immediately cease. If you wish to terminate your account, you may simply discontinue using the service or delete your account within the app.

9. CHANGES TO TERMS

We recommend reviewing these Terms periodically for updates. When we make significant changes, we will identify the date of the updated Terms & Conditions in the app or by email. Your continued use of our services after such notification constitutes your acceptance of the updated Terms & Conditions.

10. GOVERNING LAW

These Terms & Conditions and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions.

However, if you are a consumer residing in the European Union, the United States, Canada, or India, you may benefit from additional mandatory protections afforded to you by the laws of your country of residence.

Nothing in these Terms affects your rights as a consumer to rely on such mandatory local law provisions or to bring a claim in the courts of your country of residence where such rights cannot be excluded by contract.

11. SEVERABILITY

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
